There will be no cash payout for a New York anesthesiologist who sued her physician ex-husband because he accessed her e-mails for seven years as they separated, divorced and sparred over custody and support.
A White Plains federal jury has decided not to award damages in the bizarre post-marital dispute, which ended Friday with judge and jurors frustrated by the behavior of both the highly educated former spouses.
"I found this case disturbing because of the ex-husband's conduct," Judge Vincent Briccetti said after the speedy afternoon verdict.
But while Dr. Adel Abadir should never have snooped on his ex's e-mails, the ex-wife, Dr. Annabelle Zaratzian, shouldn't have used federal wiretap laws and the US court system to get back at him, Briccetti said.
"It could have been resolved without putting everyone though so much emotional turmoil," the judge said.
Jurors, too, agreed the dispute should never have been brought to federal court. And while Abadir's snooping was indeed bad, Zaratzian's claim of not having consented to — or promptly discovered — the joint e-mail account was also hard to believe.
"We thought it was bad" what Abadir did, said one male juror who asked not to be identified. "But her story" on the witness stand "seemed like it was scripted."
Meanwhile, Zaratzian gloated through her lawyer — her new husband, Howard Burke — that the case establishes that "anyone who does this is at risk of being brought into court."
