ALBANY— Domestic-violence victims would be able to break a cellphone contract without paying penalties under newly proposed legislation.

A bill sponsored by Assemblywoman Nily Rozic (D-Queens) would require phone companies that offer shared or family plans to waive early-termination fees — as much as $350 in the case of Verizon — if one of the lines is used by someone who becomes a victim of domestic violence.

Sponsors of the bill say domestic-violence victims are often trapped in family plans where they are constantly harassed by their batterer.

"We want to put a stop to that," Rozic said.

The bill is being sponsored in the state Senate by Kevin Parker (D-Brooklyn).

On Wednesday, City Councilman Rafael Espinal (D-Brooklyn) is jumping on board by introducing a resolution supporting the measure.

"Every year, approximately 99,719 victims break free from the chains of domestic violence. Cellphone contracts are keeping them hostage to an abusive relationship," Espinal said in a statement.

Sponsors of the legislation say before sharing plans became popular, domestic-violence victims were able to protect themselves by using an anonymous listing or alternative name for no extra charge. But as companies added sharing and family plans, such anonymity became more difficult.

No cellphone providers have endorsed the bill so far.
