Can I ask for flex time if my coworker did?

After 15 years of great performance evaluations, I got a new boss, and all of a sudden it seemed I couldn't do anything right. I got slammed in my next review and fired less than a year later. I was told it was a job elimination — but at 57 I think that's bogus. Can I get legal representation?

I'll resist my typical temptation for snark, because asking if you can get legal representation in this country is like asking . . . well, no, I'm not gonna do it! Besides, you've lost your job, and I am sorry about that. You can get a lawyer, but it is impossible for me to know if you have a case — thee is nothing inherently unlawful about a new management team having a different point of view from the previous management team about what is acceptable performance. And sometimes it is more about the business needs changing and the fact that what used to be good performance no longer applies. If you feel wronged, then by all means satisfy yourself and get some advice. But also spend energy on rallying and figuring how to apply your skills and experience in a new job.

My colleague took time off to have a baby and was granted permission to come back on a flexible schedule. But when I asked for the same arrangement I was told no. Is that fair? Do I have any recourse?

Again with the "fair." Folks, listen, this isn't T-ball, where everyone swings until they get a hit, no one keeps score and everyone wins. You can be treated differently as long as the treatment isn't based on protected reasons like gender, race and age — and usually, the different treatment has to do with how much flexibility and consideration the employee has earned due to his or her strong performance and value, in addition to how effectively the flexible arrangement can work given his or her particular role. Feel free to ask your boss why your request was denied while others were approved so that you get an explanation. And, if possible, look for ways to address the reasons why — and if you do, perhaps your manager will reconsider.
