Law firm ripped up blood-stained carpet after sex assault: suit

Bosses at a Manhattan law firm not only turned a blind eye when a partner "painfully and forcefully" had office sex with a subordinate after a December 2011 holiday party – but they tried covering it up by ripping out a carpet stained with blood from the intercourse, an attorney for the alleged victim charged Monday.

"They removed and discarded the carpet so" the large bloodstain "could not be identified," lawyer Harry Lipman told Manhattan federal court jurors during opening statements for a trial to decide a $9 million sexual harassment lawsuit by his client, Alexandra Marchuk, against her ex-employer Faruqi & Faruqi LLP.

Marchuk, 28, claims senior partner Juan Monteverde subjected her to unwanted requests for oral sex and other unwanted advances while she worked as an associate for the law firm from September to December 2011. Lipman said the firm's partners protected Monteverde because he was their "meal ticket" and among Faruqi & Faruqi's highest earners.

However, Scott Bursor, a lawyer representing the firm said he will call up more than seven witnesses who'll testify Marchuk pursued the married Monteverde.

He said one firm staffer who sat next to Marchuk and Monteverde in the office will say Marchuk "followed him around the office like a lost puppy dog" and another will confirm that the young lawyer was very upset after learning her boss' wife was pregnant.

The lawyer also tried to shoot down the missing carpet angle, saying Marchuk never complained Monteverde sexually assaulted her until after she resigned and that she convinced Monteverde to throw coffee over the blood stain because she was embarrassed and did not want office staffers to gossip. He also said a gynecologist who diagnosed Marchuk after the sexual encounter will testify she told him the sex was consensual.

In a $15 million-plus counterclaim, the firm and Monteverde accuse her of defamation, saying she sent copies of her complaint to the firm's clients, to opposing counsel in its cases, and to Monteverde's wife. However, that counterclaim was later dropped, and Marchuk later amended her claim to include allegations of defamation and malicious prosecution in response to the countersuit.

Monteverde in court papers had alleged he was too drunk to get an erection during the alleged attack and that Marchuk threw herself at him.
