News that Eric Garner's family will sue the NYPD for $75 million was hardly unexpected. Nor is it any surprise the Rev. Al Sharpton appears to be calling the shots.

We appreciate the plight and grief of the Garner family. Their loved one is dead, and the city medical examiner has blamed a police chokehold (though the official report justifying that claim still has not been released).

Still, it bears repeating: There would have been no chokehold if Eric Garner hadn't resisted arrest for selling illegal cigarettes.

The Garner family's lawsuit follows the release of a report by the newly aggressive Civilian Complaint Review Board alleging the NYPD has an ongoing chokehold problem. The two are intrinsically related.

There's nothing new in that: New York is home to an entire industry of activists and lawyers going after our police for both politics and profit, and this suit features some of the same actors.

But the Garner lawsuit is about much more than dollars. Its targeting of "broken windows policing" is but the latest progressive broadside against police tactics that have kept New Yorkers safe for two decades.

Before this year, these legal attacks met with a firm pushback from City Hall. Today, it's a completely different story. Now we have a mayor who seems to be giving these suits his tacit support by agreeing to fat settlements — witness the recent $41 million payout to the Central Park 5.

We do not yet have the whole story about Eric Garner's terrible death. But what's already clear is that the industry that feeds off these human tragedies is back in business. And New Yorkers are going to feel the costs in their wallets and on their streets.
