Texas Monthly magazine sued the New York Times on Friday for poaching its editor.

Jake Silverstein, who was hired away from the Emmis Communications title last month to become the new editor of the New York Times Magazine, was under contract at the regional monthly until the Times, "without legal justification or excuse," caused him to breach that deal, the lawsuit claims.

The six-page Texas state court action alleges that Times Executive Editor Jill Abramson started recruiting Silverstein in December 2012 — a full year before then-magazine editor Hugo Lindgren was ousted.

Greg Loewen, president of Emmis, said the company has been "damaged by the Times and expects to be compensated."

No precise damages are asked for in the suit. Silverstein was hired by Abramson on March 28.

The Times insists it had permission to recruit Silverstein.

"We had an understanding with Emmis during the search that Jake would be permitted to exit his contract with Emmis and take the job," a Times spokeswoman said. "Inexplicably, Emmis has instead decided to initiate litigation. We believe there is no basis for a lawsuit."

Emmis said it was promised by the Times that it would be compensated for losing Silverstein.

Silverstein could not be reached for comment.
