A Midtown cobbler is trying to keep from getting the boot.

Jim's Shoe Repair has been at 50 E. 59th St. between Park and Madison avenues since 1940, but a neighboring Duane Reade wants its space, the landlord wants to give it to them, and the Landmarks Preservation Commission won't help.

Joseph Rocco Jr., 56, whose Italian-immigrant grandfather, Vito S. Rocco, opened the shop in 1932 , is hauling the commission to court for denying his application for landmark status.

His son, Andrew, 24, currently runs the register.

Shop attorney Bill Brewer said landlord SL Green Realty Corp. has refused to renegotiate the lease.

Jim's maintains "an Old World style" with "rich wood and brass fixtures," the suit says. A commission spokeswoman said the members determined that the store "did not rise to the level of an interior landmark."
