Clock ticking for Cuomo to weigh on delivery drivers

Written By Unknown on Jumat, 20 Desember 2013 | 18.18

Gov. Cuomo in the next few days will either be delivering for the Teamsters or employee-owned UPS.

He has until the end of the year to sign the Teamsters-supported Fair Play Act that could force many delivery firms in the state to list their drivers as employees, which would likely result in higher pay for them.

But the act exempts FedEx Ground — allowing it to keep classifying its drivers as independent contractors.

UPS has recently written the governor saying it urges him to veto the bill.

The bill that passed this summer by a wide margin will die if the governor does not sign it this year.

UPS said it would like the governor to "engage affected stakeholders to consider alternate solutions … in a comprehensive manner."

The Teamsters, meanwhile, support the measure, believing nonunion truckers, who would be helped by the law, might ultimately become union members.

One driver told The Post he is hoping for passage so his company could start paying him hourly and not on a commission basis.
